IWANAI RESORT - YukiKamui Inc. (Iwanai, Hokkaido) - PARTICIPANT AGREEMENT

Definitions:
In this agreement:
a) The term “skiing” encompasses snowboarding and telemark skiing.
b) The term “wilderness skiing” refers to snowcat skiing and includes all activities, services, and the use of facilities related to snowcat skiing, including but not limited to: orientation and instructional sessions; transportation; accommodation; food; recreational activities; movement in or around snowcats; and all skiing and other activities in alpine terrain.
Assumption of Risks – Avalanches, Alpine Terrain, Wilderness Travel, and Weather Conditions:
I acknowledge and understand that wilderness skiing entails inherent risks, dangers, and hazards beyond those typically associated with downhill skiing. These risks include but are not limited to the occurrence of avalanches in alpine terrain, which may be triggered by natural forces or by participants. I am aware that the terrain used for wilderness skiing is uncontrolled, unmarked, and not subject to regular inspection.
The risks inherent in wilderness skiing include, without limitation: avalanches, ice, snow cornices, trees, tree wells, rocks, cliffs, crevasses, snowcat roads, road banks, fences, other natural and man-made obstacles, and variable snow conditions. Additional risks may arise from the negligence of other skiers, equipment failure, and the inherent risks associated with traveling in remote and extreme alpine environments. Furthermore, communication and rescue efforts in the alpine environment may be limited, and adverse weather conditions may cause sudden, unpredictable hazards.
By signing this agreement, I fully acknowledge and accept these risks and the possibility of personal injury, death, property damage, or loss resulting therefrom.
Release of Liability, Waiver of Claims, and Indemnity Agreement:
In consideration for being permitted to participate in wilderness skiing provided by the Operator, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I agree as follows:
Waiver and Release of Claims: I hereby waive any and all claims, demands, actions, and causes of action against the Operator, its directors, officers, employees, agents, guides, contractors, representatives, and assigns (hereinafter collectively referred to as “Releasees”) arising from my participation in wilderness skiing. This waiver includes, but is not limited to, claims of negligence, breach of contract, breach of statutory duty, and breach of any other legal duty, including duties under the Occupiers Liability Act or similar laws, whether or not such claims arise from the Releasees’ failure to safeguard or protect me from the risks and hazards associated with wilderness skiing. This release applies to all personal injuries, death, property damage, or loss sustained during my participation in wilderness skiing.
Indemnification and Hold Harmless: I agree to indemnify and hold harmless the Releasees from any and all liability for any claims, damages, or expenses incurred by third parties as a result of my actions during my participation in wilderness skiing.
Binding Effect: This Agreement shall be binding upon my heirs, next of kin, executors, administrators, and personal representatives in the event of my death or incapacity, and shall be enforceable by them.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Japan. Any litigation or legal proceedings arising out of or in connection with this Agreement shall be conducted solely in the courts of Japan, and I consent to the exclusive jurisdiction of the Japanese courts.
No Reliance on Statements Outside the Agreement: I acknowledge that I am not relying on any representations or statements made by the Releasees, whether oral or written, concerning the safety of wilderness skiing, except as explicitly stated in this Agreement.
Financial Terms:
Vertical Meter Guarantee: The Operator guarantees a minimum of 2000 vertical meters of skiing for each paid day of participation. If I, or my group, fail to ski due to any reason, the vertical meters performed by the snowcat will be calculated. If the total vertical meters for the day fall below 2000 meters, the Operator will issue a voucher for the remaining vertical meters. The voucher will be valid for use within 1 year from the date of issuance and is non-transferable, unless otherwise agreed to by the Operator.
No Cash Refunds: No cash refunds shall be issued under any circumstances. These financial terms do not apply to promotional, media, or discounted offers, which may be subject to separate conditions.
Acknowledgment and Confirmation:
I confirm that I have carefully read, fully understand, and voluntarily agree to the terms and conditions set forth in this Agreement. I acknowledge that by signing this Agreement, I am waiving certain legal rights that I, my heirs, next of kin, executors, administrators, or representatives may have against the Releasees.

CAT TOUR TERMS & CONDITIONS

Refund policies are as follows: cancellations made 30 days prior to the event are eligible for a 100% refund, those made 29 to 14 days prior receive a 50% refund, and cancellations within 14 days are non-refundable. However, you may transfer your booking to another client.
All refunded cancellations are subject to a non-refundable processing fee of 3.6%.
Refunds for ski rentals, accommodations, and other services are only available with five days' notice provided by the client.
We recommend that all participants obtain trip cancellation insurance to safeguard against unforeseen circumstances like injuries, transportation issues, or unexpected illness. Additionally, please note that we do not offer refunds for snowcat tours affected by weather-related conditions such as extreme avalanche risks or torrential rain.
All rates and refunds are calculated and processed in Japanese Yen.
Our refunds do not cover any losses incurred from currency exchange rates or fees imposed by banks or credit card companies.
Reservations are only confirmed upon full payment on a first-come, first-served basis.
While we strive to deliver the best skiing experience daily, we cannot guarantee untracked powder snow. Opting out of our CAT tour due to unsatisfactory conditions will not result in a refund.
All participants must read and sign our liability waiver before joining the tour; failure to do so will result in tour cancellation without a refund.
Minors under 18 years of age require a parent or legal guardian to sign their release of liability and accompany them on the tour.
We rely on honesty about skill levels. If your skills aren't up to par for the tour, we'll try to accommodate you. But our guides may ask you to return to the lodge, and refunds won't be issued.
All participants must wear a helmet while engaging in downhill activities.
Late arrivals to the tour may miss the morning session, disrupting the flow of the day for those who arrived on time. However, you're welcome to join the tour after lunch.
Rescheduling requests made by the client after October 31st will incur a ¥10,000 fee per seat.
When booking a private CAT, we will only accept payment from a single person.
Clients who have purchased a transfer package must confirm their accommodation details and guest numbers at least 72 hours prior to their visit, or the transfer will be void and non-refundable.
Vouchers are non-transferable and can only be redeemed by the named recipients. They are valid for one year from the issue date.
